Booking Policy

We have a 24-hour advance booking policy for all sessions and as such WE DO NOT OFFER SAME DAY BOOKING. This advance notice is required so that we can ensure appropriate staffing. Our online booking tool will not show time slots less than 24 hours in the future. WE DO NOT TAKE BOOKINGS OVER THE PHONE, so please schedule all your training sessions through your account. Rescheduling, Cancellation & No-Show Policy

We have a 24-hour advance rescheduling or cancellation policy. Rescheduling or cancellation can be completed online at any time before your appointment, however, if you need to cancel or reschedule less than 24 hours in advance, we reserve the right to charge a non-refundable fee equal to the full retail value of the session for repeated late reschedules, cancellations, or no-shows (“repeated” being defined as two (2) or more of any combination of late reschedules, cancellations, or no-shows). To facilitate the processing of any required fees the original form of payment will be stored and automatically charged for fees as needed.

Behind The Wheel Policy

If your purchase includes Behind-the-Wheel training, the Driver must complete their simulator training and receive instructor approval to progress to their Behind-the-Wheel lessons. Progression to Behind-The-Wheel training is not guaranteed. In the event that a student is not approved to move on to Behind-The-Wheel training Greenlight staff will advise on the appropriate course of action for the student which may include additional simulator training before earning approval to progress to Behind-The-Wheel training or a termination of the training program. In the event of a termination of training Greenlight will refund the remaining unused portion of the effected customer’s purchase.

All Behind-The-Wheel students are required to have a valid learner’s permit or driver’s license in their possession at each lesson. We reserve the right to charge a non-refundable fee equal to the full retail value of the session for failure to bring the required permit or license to the training session. To facilitate the processing of any required fees the original form of payment will be stored and automatically charged for fees as needed.

Welcome to Greenlight Driver Training. By enrolling in or using any of our services, including behind-the-wheel training and simulator-based training, you (the “Participant” or “Student”) agree to be bound by the following terms and conditions. Please read them carefully.

1. Services Provided

Greenlight Simulation, LLC dba Greenlight Driver Training (“Greenlight”) offers the following services (the “Services”) at its facilities listed in Exhibit A (the “Premises”):
• Behind-the-Wheel Training: In-car driving lessons with a California DMV certified instructor.
• Simulator-Based Training: In-person training at our Premises using driving simulators.

All Services are provided by certified and licensed instructors in compliance with California Department of Motor Vehicles regulations (California Code of Regulations, Title 13, § 340.00 through 342.05)

Simulator-Based Training is a supplemental learning tool and does not count toward the minimum required instructional hours for state driver licensing.

2. Eligibility and Enrollment

The Services are designed for Students who are old enough to legally hold a drivers license or learners permit or are within 12 months of being eligible of obtaining a learners permit (14 and a half years old). Students under 14 years of age are not eligible to enroll. We welcome them once they reach the minimum age requirement.

All Students must complete the registration process and provide accurate information. Misrepresentation of information may result in the termination of Services without a refund.

If your Services includes behind-the-wheel training, the Student must complete their simulator training and receive instructor approval to progress to their behind-the-wheel curriculum. Progression to behind-the-wheel training is not guaranteed. In the event a Student is not approved to move on to behind-the-wheel training, Greenlight will advise on the appropriate course of action for the Student, which may include additional simulator training or termination of the Services. In the event of termination, Greenlight will refund the remaining unused portion of the Services purchased.

For all behind-the-wheel training, students must possess a valid, unexpired California learner’s permit or drivers license. The permit or license must be in the Student’s possession during all lessons. We reserve the right to charge a non-refundable fee equal to the full retail value of the session for failure to bring the above required materials.

3. Fees, Payments and Refunds

Payment: All fees for Services are due in full at the time of purchase, unless a payment plan is selected for eligible Services. In the event of non-payment for Services, Greenlight reserves the right to restrict scheduling of future lessons and/or withhold any certificate(s) of completion. To facilitate the processing of any required additional fees (such as No Shows or failure to meet Student Responsibilities and Conditions), the original form of payment will be stored and automatically charged as needed.

Refunds: Refunds are available for the lesser of (i) twelve (12) months from the date of purchase, or (ii) nine (9) months from the first completed lesson. All refund requests must be made in writing to yogreenlight@greenlightdrivertraining.com. Payments are non-refundable once a lesson has been conducted. Refunds for unused Services shall be calculated by deducting the then current full retail price of Services used from the total purchase price. For example, if you purchased a six-simulator lesson package for $600 using a discount code (current full retail price of $750) and completed the first two sessions with each lesson valued at $125 each ($750/6 lessons = $125), the refunded amount will be the $600 paid minus the $250 (2 x $125) in full retail value of the completed sessions, or $350 ($600-$250=$350) for the remaining lessons. Refunds shall be made via the original payment method within 10 business days.

Unless otherwise approved in writing by Greenlight, all Services must be completed within twelve months of the first completed lesson.

4. Scheduling and Cancellation

We do not take bookings over the phone, so please schedule all your training sessions through your account and/or the links provided in the purchase confirmation email.

Rescheduling, Cancellation & No Show Policy: We have a 24-hour advance rescheduling or cancellation policy. Rescheduling or cancellation can be completed online at any time before your appointment, however, if you need to cancel or reschedule less than 24 hours in advance, we reserve the right to charge a non-refundable fee equal to the full retail value of the session for repeated late reschedules, cancellations, or no-shows (“repeated” defined as two (2) or more occurrences).

Greenlight Cancellation: Greenlight reserves the right to cancel or reschedule lessons due to unforeseen circumstances, including but not limited to instructor illness, vehicle maintenance, simulator maintenance or severe adverse weather conditions. We will notify you as soon as possible and a credit will be applied to your account for the rescheduled lesson.

5. Student Conduct and Responsibilities

Student hereby understands and agrees that he/she shall abide by all Greenlight’s rules, regulations, restrictions, guidelines and policies at all times while using the Services

• Appropriate Behavior: Students are expected to be respectful and cooperative with instructors and staff at all times. Greenlight reserves the right to terminate a lesson or services if a student exhibits disruptive, disrespectful, or dangerous behavior.

• Zero Tolerance Policy: There is a zero-tolerance policy for drug and alcohol use. Instructors may refuse to conduct a lesson if they suspect the Student is under the influence of any substance. No refunds will be issued in such cases.

• Cell Phones: For the safety of the Student and instructor, cell phone use is strictly prohibited during all behind-the-wheel and simulator training sessions

• Condition: For all behind-the-wheel and simulator lessons, Students must ensure they are in a fit condition to drive, including having any required corrective eyesight devices, and wear appropriate footwear. For clarity, open-toed, open-heeled, loose, or bulky footwear such as flip flops, Crocs or slippers are not permitted.

• Compliance: The Student agrees to follow all instructions from the instructor and obey all traffic laws during behind-the-wheel training. Failure to comply may result in the immediate termination of the lesson.

6. Liability and Safety

Simulator Training: The driving simulators are designed to be a safe and educational tool. Greenlight is not liable for any physical or psychological distress that may arise from simulator use.

Behind-the-Wheel Training: Greenlight and its instructors will take all reasonable precautions to ensure the safety of students during lessons. However, driving inherently involves risks.

Limitation of Liability: In no event will Greenlight, its suppliers or licensors, be liable with respect to any subject matter of the Terms under any contract, negligence, strict liability or other legal or equitable theory for: (i) any personal injury, property damage or special, incidental or consequential damages; (ii) the cost of procurement for substitute Services; (iii) for interruption of us of loss of corruption of data; or (iv) for any amounts that exceed the feed paid by you to Greenlight under these Terms. Greenlight shall have no liability for any failure or delay due to matter beyond our reasonable control. These limitations apply only to the extent permitted by California law.

7. Disclaimer of Warranties

Disclaimer of Warranties: Except as described below in Guarantee, the Services are provided “as is.” By agreeing to these Terms, you accept that the Services are in active development. There may be errors, bugs, inaccuracies, or other problems, and may not be fully functional. To the fullest extent allowable by applicable law, Greenlight and our suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Greenlight nor its suppliers and licensors make warranty that the Services will work perfectly or that access thereto will be continuous or uninterrupted. You understand that you use the Services at the Premises at your own discretion and risk.

Guarantee: Greenlight is confident that you will have an excellent experience using the Services. If for any reason you are unsatisfied with the Services, please let us know. Greenlight will arrange to redo the most recent lesson under the Services, or provide a cancellation and refund of any unused portion of the Services (in accordance with Item 3 Refunds above).

8. Privacy, Data and Media

Greenlight collects personal information from Students for scheduling, billing, and compliance with DMV regulations.

Student acknowledges that Greenlight may record lessons or events for safety, quality assurance and marketing purposes. Greenlight owns such recordings but will not use a Student’s name, image, or likeness in a misleading or defamatory context

By enrolling, Student grants Greenlight a non-exclusive, worldwide, royalty-free and perpetual right and license to use the Student’s name, image and likeness, including without limitation photographs, audio/visual content, and images and sounds of Student, in any medium for educational and marketing purposes, consistent with California Civil Code § 3344.

9. General Provisions

Agreement: This document constitutes the entire agreement between the Student and Greenlight. No other promises or agreements will be binding unless in writing and signed by both parties.

Indemnification: You agree to indemnify and hold harmless Greenlight, its contractors, suppliers and licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Services, including but not limited to your violation of these Terms.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of California. Before filing any court action, both parties agree to attempt mediation in good faith. If following mediation court action be deemed necessary, any disputes shall be resolved in the courts of Contra Costa County, California.

General Representation and Warranty: You represent and warrant that (i) your use of the Services will be in strict accordance with the Greenlight Privacy Notice ,with these Terms and with all applicable laws and regulations, (including without limitation any local laws or regulations in your country, state, city, or governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Services will not infringe or misappropriate the intellectual property rights of any third party.

Severability: If any part of these Terms are held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of these Terms or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

Amendments: Greenlight reserves the right to amend these Terms of Service at any time. The most current version will be posted on our website. Continued use of our Services constitutes acceptance of the updated terms.

Termination: Greenlight reserves the right to add or remove features to the Services and we may also suspend or stop the Services altogether. Greenlight may take any of these actions at any time.

Assignment: Greenlight may assign its rights under these Terms without condition. These terms will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

By using the Services, you acknowledge that you have read, understood, and agree to the Terms of this agreement.
